OFFICIAL RULES
The Warner List Promotion (“Promotion”) is organised by Warner Home Video UK, a division of Warner Bros. Entertainment UK Limited of 98 Theobald’s Road, London WC1X 8WB (“Warner”).
In order to administer the Promotion, Warner may make use of advertising and promotional agencies (“Warner’s Agents”).
The Promotion is governed by the laws of England and Wales.
The following terms and conditions will apply to the Promotion. Entry into the Promotion assumes the acceptance of the terms and conditions below and agreement to be bound by the decisions of Warner.
How to Enter
The Promotion commences at 00.01 GMT on 21 April 2008 and ends at 23.59 GMT on 21 July 2008 (“Promotional Period”).
Participants may only enter the Promotion by (i) visiting the Promotion entry page at www.whvlist.co.uk during the Promotional Period, (ii) completing and submitting the online entry form, (iii) inserting a genuine copy of any Warner DVD regionally encoded for zone 2 into the D drive of the computer on which the entry is being submitted for online disc verification by the Digital Insert service, and (iv) clicking on the enter button (“Entry”). A computer with a D Drive is required for Entry.
Participants may submit an additional Entry for every genuine copy of a Warner DVD regionally encoded for zone 2 successfully verified by the Digital Insert service.
Eligibility
The Promotion is only open to UK residents who are aged eighteen (18) or older. The Promotion is not open to employees or contractors of Warner, its affiliates, subsidiaries and divisions or any person directly or indirectly involved in the organisation or running of the Promotion or their direct family members.
Warner will only accept one Entry for each genuine copy of a Warner DVD successfully verified by the Digital Insert service. See http://www.digitalinsert.com/terms.php for terms and conditions related to the Digital Insert service.
Ineligible or fraudulent Entries are void. Entrants will be deemed to have authorised Warner and Warner’s Agents to check the completeness and accuracy of the information supplied for the purpose of participating in the Promotion. An entrant who has supplied incomplete, inaccurate or fraudulent information will be automatically disqualified.
Warner and Warner’s Agents are not responsible for lost, late, or misdirected Entries, for technical, hardware or software failures of any kind, for lost or unavailable network connections, or for failed, incomplete, garbled or delayed computer transmissions or any human error which may occur in the receipt or processing of the Entries.
Proof of entering information on the www.whvlist.co.uk website does not constitute proof of delivery or receipt of such information. Warner is not responsible for the failure of any email or Entry to be received by Warner on account of technical problems or congestion on the internet or at any website.
Use of computer programs and other automatic means to enter the Promotion are prohibited and may result in the disqualification of the participant.
In the event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the person in whose name the e-mail account is registered on the date the Entry is submitted. All entries become property of Warner and will not be returned.
Use of Personal Information
In order to participate in the Promotion, participants will be required to supply certain information about themselves in their Entry. Warner has specified which information is mandatory in order to participate in the Promotion. This information will be used by Warner and Warner’s Agents for the purpose of administering the Promotion.
In addition, the Warner Bros. Privacy Policy shall apply to all personal information provided by the participant. The Warner Bros. Privacy Policy can be found at www.warnerbros.co.uk/main/privacy.
The first prize winner may be required to take part in reasonable post-competition publicity for Warner and may be filmed, photographed or otherwise recorded for such purposes and he/she hereby expressly consents to the use of his/her image and personal data for such purposes without further consent or payment.
The Prize Draw
The prize draw will take place on within 14 days of the closing date. The winners will be selected by means of a random software selection system. The first valid entry drawn will win the first prize (as detailed below). The next one thousand (1,000) valid entries drawn shall each win a runner up prize (as detailed below).
Warner’s decision concerning the determination of the winners and all matters relating to the prize draw will be final and binding – no correspondence will be entered into.
The Prizes
First Prize: The first prize consists of a trip for two (2) people to Los Angeles including return flights departing from a London airport, airport to hotel limousine transfers, five (5) nights accommodation at the Beverly Hills Hotel including breakfast, five hundred dollars (US$500) credit at SAKS 5th Avenue, a Warner Bros. Studio tour with transfers and travel insurance. The total value of the prize is five thousand pounds (£5,000).
The first prize does not include anything not detailed above, including, without limitation, (i) any taxes which may be payable as a consequence of receiving the first prize, (ii) any transfers, transportation, spending money, drinks or meals (other than those detailed above), (iii) any arrangements regarding passports, visas, other travel documentation, (iv) any insurance arrangements (other than those detailed above), and (v) any costs and/or expenses of anyone required to accompany the first prize winner save for the one (1) guest with whom the first prize winner is permitted to share their prize.
The first prize must be taken between 28 August 2008 and 27 August 2009 and is subject to availability and the terms and conditions of any third party service providers used to supply the prize including, without limitation, those of any airline or hotel. Both the first prize winner and their guest must be over the age of eighteen (18) and must have valid travel documentation, including a passport valid for at least ninety (90) days for the duration of the holiday and visas (as applicable), and shall be responsible for complying with any customs, immigration and other regulatory requirements for entering the United States.
The first prize winner and any other person sharing the first prize with the first prize winner may be required to sign a Prize Acceptance Form before the major prize is awarded.
Runner Up Prizes: The runner up prize consists of one thousand (1000) DVDs from The Warner List. Each runner up prize consists of one (1) standard definition DVD chosen by Warner from The Warner List collection.
No cash or credit alternative is available and prizes are not transferable.
In the event of unforeseen circumstances, Warner reserves the right to substitute any or all parts of a prize. In this event, such change will be publicised on the www.whvlist.co.uk website and any necessary amendments to these terms and conditions will be made.
Notifying the Winners
The winners will be informed by email (at the same email address submitted on their Entry) within 28 days of the closing date. Each winner will be required to confirm acceptance of their prize in an email by 12 noon on 21 September 2008 (“Confirmatory Email”). Winners must provide their full name, telephone number and mailing address in the Confirmatory Email. Prizes will be delivered to winners within twenty-eight (28) days of Warner receiving a winner’s Confirmatory Email.
If a winner does not confirm acceptance of his/her prize by 12 noon on 21 September 2008, he/she will automatically forgo their right to claim the prize and Warner will select a runner up as an alternative winner of such prize.
Winner’s List
For the names of the winners, send a self-addressed stamped envelope to: Winners List, Warner Home Video UK, a division of Warner Bros. Entertainment UK Limited, Warner house, 98 Theobald’s Road, London WC1X 8WB, within one month of the Prize Draw closing date.
Limitation of Liability
Warner does not accept any responsibility for any occurrences resulting from a participant’s connection to the internet via the www.whvlist.co.uk website and/or resulting from participation in the Promotion. In particular, Warner does not accept responsibility for any damage or loss caused in any way to participants, their computer equipment and/or to data which is stored on any such equipment, or to their personal, professional or commercial activities.
If, for any reason, the Promotion is not capable of running as planned, including infection due to computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure, human error or any other causes beyond the control of Warner that corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Promotion, Warner reserves the right to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend the Promotion and to select the winners from all eligible entries received prior to the cancellation or termination of the Promotion.
Any attempt by a participant to deliberately damage the www.whvlist.co.uk website or to undermine the legitimate operations of the Promotion may be a violation of criminal and civil laws and should any such attempt be made, Warner reserves the right to seek damages from any such person to the fullest extent permitted by law.
Warner reserves the right to change, suspend or cancel the Promotion without specifying the reasons for its decision and without incurring liability as a result.
Warner does not exclude any liability for death or personal injury arising as a result of Warner’s negligence in respect of participants’ use of the www.whvlist.co.uk website.
Participants’ use of the www.whvlist.co.uk website is subject to the Warner Bros Terms of Use.
